yours is to young I think but this will help in the future .

Your tortoise is slightly a bit young to be sure but based on carapace shape, anal scute opening and structure of tail, it's certainly looking male.

When they flash?? I don't want to sound dumb but oh well.....how do they lay eggs if they've not been around a male? I sound so dumb now

You don't sound dumb. Flashing is when his penis comes out and you see it. Sometimes during a soak this will happen. Tortoises don't need to be with a male to lay eggs, they just won't be fertile.
