What type of Tortoise?

I'm not too great at these guessing games, but it appears to be too big to be a box turtle....but not sure about a desert tortoise in Rhode Island. I don't know what else it would be though.

I'm glad everyone is as stumped as I am! I just emailed to see if there are more pictures. I'm not actually interested in buying, I'm just really curious as to its identity!

It's definitely NOT a box turtle. I'm inclined to agree with Kelly, but I'm not that familiar with the Gophers. The shell is in bad shape, texture-wise, which makes it hard for me to really guess. Maybe its an OLD tortoise.

That is not its home, but it is the home of at least one RES.

Definitely not a box turtle. My guess is Florida Gopher as well.

I wonder how the seller came across it...do you need permits to have gopher tortoise?

I sent them an email telling them its protected by law and illegal to sell or take money for it. You all should too.
