Thats a gopher and not legal to be selling in any state.
Hard to tell but it might be a 3 toed box turtle, but I'm probably wrong.

I thought box of some sort, however I have no idea what a gopher looks like.
I'm not too great at these guessing games, but it appears to be too big to be a box turtle....but not sure about a desert tortoise in Rhode Island. I don't know what else it would be though.
I'm glad everyone is as stumped as I am! I just emailed to see if there are more pictures. I'm not actually interested in buying, I'm just really curious as to its identity!

It's definitely NOT a box turtle. I'm inclined to agree with Kelly, but I'm not that familiar with the Gophers. The shell is in bad shape, texture-wise, which makes it hard for me to really guess. Maybe its an OLD tortoise.

Definitely not a box turtle. My guess is Florida Gopher as well.

I wonder how the seller came across it...do you need permits to have gopher tortoise?
