Shell problem?

what would cause a tortoise shell to do this? When we got him it was like that just a little. Seems to have got a little worse.

Russian tortoises go through a lot during the catching/shipping process. The edge of the shell was injured before you got the tortoise and now the dead part of the injury is breaking off. It will be ok, and you don't need to do anything about it.
