Mouth problems with hatchlings

Has anyone ever seen a hatchling with a mouth that can't open on its own ? A person I know has one that tries to eat but can't open its mouth . So if you can give me some insight I'll pass it on thanks . Here is a picture of the little guys mouth .

I thought maybe the jaw might be out of alignment, however it looks pretty straight in the picture. Sorry I'm not more help.

Maybe a silly suggestion, but is any of the top beak overlapping the bottom stopping it from openening the mouth.

The tortoise is at a vet now being monitored . They have found it has a respiratory infection. Hopefully that's all that's wrong to sick to eat.
