Can you help me identify this tree and bush? It's right where I'd like to put Kronks large enclosure and I want to know if I can, or if it should be avoided...

I've included the full tree and bush. Then a close up of the leaves on the bush, a close up of the tree trunk/bark and as close as I could get to tree leaves. It is a young tree and WAY up there...
The tree looks like a birch. The bush looks like this weed that sprouts out everywhere in our yard. I don't know what it is called.
