Tortoise identification

Does anyone know what kind of tortoise this is? Someone found it in the backyard and asked if I knew but I don't...

I did tell them not to give it lettuce.

California Desert Tortoise?

That is a desert tortoise. Gophers agassizii. Protected by CA law. You need a permit to keep one. The permits are cheap and easy to get form any CTTC chapter.
