hard to say from the angle. at first glance I want to say female. but the angle of the picture and the water are throwing me off. Does the plastron (belly) have a dip in it like a bowl? if so then it is a male. males also have a longer more slender tail than the females and yours appears to have a longer tail than my female. I'm going to side with Candy on this one.

I think that is a young redfoot tortoise that when cared for properly will grow up to be an older redfoot tortoise.. that will have thoughts on giving or getting sex..... depends on how you look at it. That's about all I can say...... however if I were to guess, it would be.......................................... a guess.
